Fall River County Minutes of July 3, 2018

The Fall River Board of County Commissioners met in regular session on July 3, 2018 in the courtroom on the second floor of the Courthouse. Present: Ann Abbott, Joe Allen, Joe Falkenburg, Paul Nabholz, Deb Russell and Sue Ganje, Auditor. 

The Pledge of Allegiance was stated, and the meeting called to order at 9:00 a.m.

The agenda was reviewed for conflicts; Joe Allen had a conflict with the temporary malt beverage application. All Motions Recorded in these Minutes were Passed By Unanimous Vote, Unless Otherwise Stated.

Motion made by Russell, seconded by Abbott, to approve the agenda as written.

The board was notified of union negotiations to start on July 17, 2018 with the Local 620 at 1:30 p.m.

The minutes of June 19 were discussed. Motion made by Nabholz, seconded by Russell, to approve the minutes of June 19, 2018.

Motion made by Abbott, seconded by Nabholz, to approve the temporary liquor license for Winner’s Circle at the Allen Ranch on July 7, 2018. With Allen abstaining, and all others voting yes, the motion carried. 

Dustin Ross, Andersen Engineers, met with the board. Motion made by Allen, seconded by Russell, to approve the following plat:

Fall River County Resolution #2018-12

A plat of Lot 1, Lot 2, and Tract B1 of Angostura North Subdivision of the SW1/4SW1/4 of Section 10 and the SE1/4SE1/4 of Section 9, all in T8S, R6E, BHM, Fall River County, South Dakota

WHEREAS, there has been presented to the County Commissioners of Fall River County, South Dakota, the within plat of the above described lands, and it appearing to this Board that the system of streets conforms to the system of streets of existing plats and section lines of the county; adequate provision is made for access to adjacent unplatted lands by public dedication or section line when physically accessible; all provisions of the county subdivision regulations have been complied with; all taxes and special assessments upon the property have been fully paid; and the plat and survey have been lawfully executed; now and therefore,

BE IT RESOLVED that said plat is hereby approved in all respects.

Motion made by Allen, seconded by Nabholz to approve the following resolution:

Fall River County Resolution #2018-13

A plat of Bogner’s Wild Kingdom Tract of the NE1/4 of Section 8, T8S, R7E, BHM, Fall River County, South Dakota, Containing a portion of Farm Unit #16

WHEREAS, there has been presented to the County Commissioners of Fall River County, South Dakota, the within plat of the above described lands, and it appearing to this Board that the system of streets conforms to the system of streets of existing plats and section lines of the county; adequate provision is made for access to adjacent unplatted lands by public dedication or section line when physically accessible; all provisions of the county subdivision regulations have been complied with; all taxes and special assessments upon the property have been fully paid; and the plat and survey have been lawfully executed; now and therefore,

BE IT RESOLVED that said plat is hereby approved in all respects.

Dan Cullen, Veteran’s Service Officer, met with the board. Motion made by Russell, seconded by Allen, to approve travel for Cullen to attend the SDDVA annual workshop training in Pierre on August 20, through August 22, 2018.

Cullen presented his 2019 budget request with the board and advised of office activities. He noted a record number of claims and benefits submitted and received for veterans. 

Jackie Waldner, Nurse, met with the board to discuss her 2019 budget.

Lyle Jensen, Building Supervisor, met with the board. Motion made by Nabholz, seconded by Abbott, to approve the quote from Covenant Security Equipment, in the amount of $1,659.00, to provide bullet resistant panels for the judge’s bench. A security grant will reimburse 50 percent of this cost. 

Discussion was held on a quote for the South Annex acoustics. The board asked Jensen to try and find a lower cost and bring back to the next meeting.

Susie Simkins, Director of Equalization, met with the board. Motion made by Nabholz, seconded by Allen, to approve travel for Susie Simkins and Caitlin Turner to attend the annual school in Spearfish, September 17 thru September 21, 2018. 

Motion made by Russell, seconded by Nabholz, to approve the abatement for Dennis Yohner, 75430-00500-01092, payable in 2018, in the amount of $489.16. Reason: Elderly freeze should have been applied.

Simkins spoke of a CPR class training that her office attended. They paid for the training personally, but wondered if the county would reimburse them. The board would rather look for someone to come in for multiple employees and find a less expensive avenue to do so.

Kelli Rhoe, Treasurer, met with the board to discuss her 2019 budget.

Lindsay Luper, Edward Jones advisor, met with the board. Luper spoke to the board about the possibility of investing money through a treasury with Edward Jones. The cost would be higher than the treasury they are purchasing through Schwab, but the money would be invested locally. The board asked Luper to continue to visit with Rhoe.

Sue Ganje, Auditor, met with the board to present her 2019 budgets for the auditor’s office and elections.

Motion made by Abbott, seconded by Russell, to approve the Opt-In Notice for the Class Action involving underpayment of PILT funding, 2015 - 2017, and authorize Joe Falkenburg, Chairman, to sign the notice.

Frank Maynard, Emergency Management, met with the board. Maynard updated the board on the cell booster he ordered for the South Annex, the command trailer, and fires and incidents. Motion made by Nabholz, seconded by Russell, to approve the third quarter SLA report, and authorize the chairman to sign. 

Bruce McClung, Highway Department Foreman, met with the board. Motion made by Russell, seconded by Abbott, to approve an agreement, #2018-27-1, between the County and SD Game, Fish and Parks agreement, for “Mag Water” dust control on County Road 71A (Sheps Canyon road). SDGFP shall pay the county 50% of cost, not to exceed $18,000.00

Motion made by Nabholz, seconded by Russell, to approve the Golden West Telecommunication’s application for permit to occupy county highway right-of-way located from the existing vault on northwest side of Cheyenne River Road (near culverts at river crossing) to existing vault on the southwest side of Cheyenne River Road.

Motion made by Nabholz, seconded by Russell, to approve the June 2018 fuel used or work performed to reimburse the highway department as follows: Weed & Pest for $569.28; Sheriff’s Department for $2,533.32; Building for $106.21; Emergency Management for $80.40; Director of Equalization for $62.91; State’s Attorney for $16.93 and GIS for $41.77.

No public comment was heard.

Paul Nabholz, Commissioner, met with the board. Nabholz advised he received permission from Jim Miller to walk to the north of the Chilson bridge for a possible north at-grade crossing, which he feels would be possible to be done with the money the state would send to the county. The Murdock side of the bridge would be simpler. He would like to get an estimate from Barker Construction, and contact the SD GF&P. Nabholz made a motion to have Brosz Engineering look at the detailed budget to see if we can build some form of crossing for the $966,400 offered by the state. Discussion was held by the rest of the board, other commissioners stating the decision for the bridge had already been made. Motion died for a lack of a second.

Nabholz also spoke of attending the Black Hills Council of Local Governments meeting. The transportation improvement plans were presented for the state for 2019-2022. There will be a presentation of highway projects at the Ramkota at 7 p.m. on July 12. Nabholz also noted the BHCOLG’s financial situation involving investments.

Melody Engebretson, Register of Deeds, met with the board to discuss her 2019 budget.

Bob Evans, Sheriff, met with the board. Motion made by Russell, seconded by Abbott, to approve hiring Daniel Leetch (Jailer) at $14.50 per hour, effective date June, 18, 2018, as per union contract.

Evans discussed the Edgemont Law Enforcement Contract, hoping for a similar contract to what has been in the past. Evans noted the need to clarify certain items that he is only able to enforce as the sheriff, such as traffic ordinances, etc. Edgemont Mayor Jerry Dibble is willing to help with this. If the contract is not renewed, the sheriff’s department would still have to go to Edgemont in case of emergency or felonies, but they would not be obligated to patrol anymore or deal with certain school issues. Discussion was held on nuisance complaints. More would be on the next agenda concerning this.

Wayne Evans met with the board. Motion made by Nabholz, seconded by Allen, to approve the delinquent tax agreement with Wayne Evans, parcel #72100-00800-01000, $200.00 per month.

Joe Falkenburg, Commissioner, met with the board. Falkenburg discussed the importance of Prairie Hills Transit. Concerns were raised about the City of Hot Springs not supporting PHT anymore. Falkenburg hopes the board gets behind this.

Motion made by Russell, seconded by Nabholz, to enter executive session as per SDCL 1-25-2 (4) for pre-negotiations at 11:18 a.m. Meeting reconvened at 11:27 a.m.
