Regular Meeting
August 7, 2018

Call to Order – Roll Call: Mayor Jerry Dibble called the regular meeting of the Edgemont Common Council to order at 7:00 P.M. on August 7, 2018, at Edgemont City Hall. Present were Council members, Terry Leehey, Carla Schepler, Jason Shook, Sandra Woodard and Robert Worden. Barbara Strozewski was absent.

The Pledge of Allegiance was stated.

Conflict of Interest for Council Members: No conflicts were heard.

Approval of Agenda: Carla Schepler made a motion to approve the August 7, 2018 agenda. Motion seconded by Sandra Woodward. Motion passed with unanimous vote. 

Approval of Minutes: Sandra Woodward made a motion to approve the July 3, 2018 minutes. Motion was seconded by Jason Shook. Motion passed with unanimous vote. 

Committee Reports:

Law Enforcement – no officer present

Public Works Committee – Sandra Woodward

Finance/Personnel Committee – Sandra Woodward stated that the claims were reviewed and approved. Mayor – Mayor Dibble wanted to thank everyone in the City for making things look nice for the Fair.

Public Comment: Carl Shaw wanted thank the City, on behalf of the Fair Board, for all of their efforts to make this year’s County Fair enjoyable for everyone.

Approval of Claims: Sandra Woodward made a motion to approve the August 7, 2018 claims totaling $69127.95. Motion seconded by Robert Worden. Motion carried with unanimous roll call vote.

Old Business: Ordinance 2018-07-17-1 – Water Works – Second Reading: Sandra Woodward made a motion to adopt Ordinance 2018-07-17-1 as read. 

Ordinance 2018-07-17-1: 

An Ordinance Amending Chapter 12 of the Edgemont Code of Ordinances passes On November 20, 2012.

Chapter 12 of the Edgemont Code of Ordinances; Water Works; shall be amended as follows: 

12.04.00 Service Lines: All water works service lines, fixtures and clean-outs extending from the premises served to the curb stop (meter pit) in the public right-of-way is the responsibility of the property owner to service and maintain. All water service lines and fixtures installed and connected to the municipal water main shall be kept in good working order, and properly protected from frost and other damage at the expense of the owner.

12.05.00 Water, Sewer and Sanitation Connection Required: No person shall occupy any structure within the City of Edgemont unless said structure is connected to the City of Edgemont’s water, sewer and sanitation services. Any violation of this Ordinance may result in the City declaring the structure to be a public nuisance and a menace to the public welfare, comfort, and safety and health of the community. Any person having charge of any structure which is near any street in which the common sewer is or may be laid, shall within fifteen (15) days after written notice connect his/her dwelling or house with the water, sewer and sanitation services from the City of Edgemont, if the said structure shall accommodate humans. Said notice shall be signed by the City, served by any law enforcement officer, and any person disregarding such notice shall be guilty of a misdemeanor.

12.05.01 Connection Penalty: Any act or omission made unlawful or prohibited by any provision of this chapter shall be punishable by a fine not to exceed two hundred dollars ($200.00), and in the event such violation shall be continuing in nature, such fine shall be imposed at a rate not exceeding two hundred dollars ($200.00) per day. Further, such fine shall be in addition to and not in lieu of any other, further, additional, or different remedies available to the City pursuant to the Code of Ordinances for the City of Edgemont. 

12.05.02 Additional Penalties: In addition to those penalties described in section 12.02.01, 12.03.02 and 2014-07-15-01, any property owner and/or utility user who violates ordinance sections 12.02.01, 14.04.00 or is more than 90 days past due for paying for any City utility service is, at the discretion of the City, subject to having their sewer service capped at the sewer main. Prior to being allowed to tap into the sewer line after same has been capped pursuant to this ordinance, the property owner or water user must pay a flat fee of $400 to cover the cost to the City of capping the sewer along with all other overdue amounts, including interest and penalties established by other ordinance or resolution of the Council, prior to the reestablishment of sewer service to the offending property. The cost of tapping into the sewer system after disconnection pursuant to this ordinance shall be the responsibility of the property owner and/or utility user, and shall be subject to written pre-approval from the City of Edgemont, all applicable building codes then in effect and inspection by the City of Edgemont.

The City Council of Edgemont, South Dakota shall have the authority to change the provisions of this Ordinance by Resolution.

Any Ordinance or Parts of Ordinances in Conflict with this Ordinance are Hereby Repealed.

This Ordinance shall become law upon its passage and publication.

Ordinance 2018-07-17-2 – Sewer – Second Reading: Sandra Woodward made a motion to adopt Ordinance 2018-07-17-2 as read.

Advertise For Bids – Block 6, Lots 3,4 & 5, Original Town: Carla Schepler made a motion to advertise for bids for Block 6, Lots 3,4 & 5, Original Town. Motion was seconded by Jason Shook. Motion carried with a unanimous roll call vote. 

Advertise For Bids – Block 7, Lot 5, Original Town: Jason Shook made a motion to advertise for bids for Block 7, Lot 5, Original Town. Motion was seconded by Robert Worden. Motion carried with a unanimous roll call vote.

Side X Side: Discussion was held concerning purchasing a side x side for the Utility Crew.

Resolution 2018-08-07 – Authorizing Finance Officer 

Resolution 2018-08-07

A Resolution Authorizing Finance Officer To Sign And Certify Documents And Any Other Items Necessary To Complete The Usda Rural Development Search Grant Application And To Complete An Application To Usda Rural Development For Funding For A Water Project.

WHEREAS, the City of Edgemont (the “City”) has determined it is necessary to proceed with improvements to its Municipal Utility Infrastructure, including but not limited to: replacement of water and sewage mains (the Project).

WHEREAS, the City has determined that financial assistance will be necessary to undertake the Project and an application for financial assistance to the USDA Rural Development SEARCH grant and an application to USDA Rural Development for funding for Project.

WHEREAS, it is necessary to designate an authorized representative to execute and submit the Application on behalf of the City and to certify and sign payment requests in the event financial assistance is awarded for the Project.

NOW THEREFORE BE IT RESOLVED by the City as follows:

1. The City hereby approves the submission of an Application for the USDA Rural Development SEARCH Grant for the Project.

2. The Finance Officer is hereby authorized to execute the Application and submit it to the USDA Rural Development for the SEARCH grant and application to the USDA Rural Development for funding.

3. The Finance Officer is hereby designated as the authorized representative of the City to do all things on its behalf to certify and sign payment requests in the event financial assistance is awarded for the Project.
